El sometimiento del juez a la ley está comprendido en el más general “principio de legalidad”, cuya consagración jurídico-positiva aconteció en el siglo XVIII (en Europa, sobre todo, tras la Revolución Francesa). Pero la relación entre el Juez y la Ley, que en aquel contexto no plantaba problemas (el juez debía aplicar la ley, supuestamente certa et clara), se inserta ahora en un marco (teórico, político e institucional) muy diferente. En el interior de un sistema, la alteración de uno de (...) sus elementos suele entrañar la necesidad de modificar algunos de los restantes, o de todos; de lo contrario, el sistema o bien se desestructura, o bien se convierte en otro distinto. En una inicial relación triangular entre Ley, Juez y Certeza, la posterior redefinición de la Ley en clave post-positivista pero manteniendo inalterado el concepto positivista primigenio de Certeza, acarrea la desnaturalización del Juez constitucional (el cual pierde uno de sus atributos esenciales: la independencia). This article presents three studies examining the importance of identification with characters in research on media entertainment. In Study 1 it was found that identification with characters was associated with spectators' degree of enjoyment of feature films of different genres. Study 2 showed that identification with characters predicts the affective impact of a dramatic film and, also, it was associated with greater cognitive elaboration and a more complex reflexive process during the viewing of the dramatic film. In Study 3 it (...) was observed that identification with characters predicted the incidental impact of a full length fictional film on attitudes and beliefs. These results support the centrality of the construct of identification with characters in narrative persuasion research. (shrink)

This study focuses on a news framing analysis of Latin America and Latin Americans in the Spanish press. For this purpose 1,271 news articles with different Latin American countries or their citizens as main actors were examined. These news stories had been published by the main Spanish newspapers in 1999. The results reveal that attribution of responsibility, human interest, and conflict constitute the prevailing frames used by the Spanish press. Furthermore, significant differences in the considered variables in terms of main (...) country actor were observed. Venezuela and Colombia, in particular, are associated with armed conflicts, natural disasters, crimes, and accidents using human interest and conflict news frames. This leads to a necessary consideration of the consequences this type of news coverage on Latin America may generate, and whether it will reinforce stereotypes or prejudices in the Spanish audience against peoples from these countries, especially those with a high migratory influx to Spain. Three studies are presented to validate the Spanish version of Oliver and Raney’s eudaimonic and hedonic motivations scale. In Study 1, 132 university students watched a dramatic film, filling out the scales to evaluate motivations regarding cinema consumption and reception processes. Eudaimonic motivation was associated with deeper cognitive processes during the reception and stronger identification with the protagonist. Study 2 evaluated the test-retest reliability of the eudaimonic and hedonic motivations scale. In Study 3, statistically significant age differences were observed in (...) hedonic and eudaimonic motivations. Furthermore, convergent correlations were detected between hedonic and eudaimonic motivations and preferences of different film genres. These results allow us to conclude that the Spanish version of the hedonic and eudaimonic motivations scale presents adequate psychometric properties, thus being convergent with those obtained by Oliver and Raney. The use of black box algorithms in medicine has raised scholarly concerns due to their opaqueness and lack of trustworthiness. Concerns about potential bias, accountability and responsibility, patient autonomy and compromised trust transpire with black box algorithms. These worries connect epistemic concerns with normative issues. In this paper, we outline that black box algorithms are less problematic for epistemic reasons than many scholars seem to believe. By outlining that more transparency in algorithms is not always necessary, and by explaining that (...) computational processes are indeed methodologically opaque to humans, we argue that the reliability of algorithms provides reasons for trusting the outcomes of medical artificial intelligence. To this end, we explain how computational reliabilism, which does not require transparency and supports the reliability of algorithms, justifies the belief that results of medical AI are to be trusted. We also argue that several ethical concerns remain with black box algorithms, even when the results are trustworthy. Having justified knowledge from reliable indicators is, therefore, necessary but not sufficient for normatively justifying physicians to act. This means that deliberation about the results of reliable algorithms is required to find out what is a desirable action. Thus understood, we argue that such challenges should not dismiss the use of black box algorithms altogether but should inform the way in which these algorithms are designed and implemented. When physicians are trained to acquire the necessary skills and expertise, and collaborate with medical informatics and data scientists, black box algorithms can contribute to improving medical care. Several philosophical issues in connection with computer simulations rely on the assumption that results of simulations are trustworthy. Examples of these include the debate on the experimental role of computer simulations :483–496, 2009; Morrison in Philos Stud 143:33–57, 2009), the nature of computer data Computer simulations and the changing face of scientific experimentation, Cambridge Scholars Publishing, Barcelona, 2013; Humphreys, in: Durán, Arnold Computer simulations and the changing face of scientific experimentation, Cambridge Scholars Publishing, Barcelona, 2013), and the explanatory power of (...) computer simulations :277–292, 2008; Durán in Int Stud Philos Sci 31:27–45, 2017). The aim of this article is to show that these authors are right in assuming that results of computer simulations are to be trusted when computer simulations are reliable processes. After a short reconstruction of the problem of epistemic opacity, the article elaborates extensively on computational reliabilism, a specified form of process reliabilism with computer simulations located at the center. The article ends with a discussion of four sources for computational reliabilism, namely, verification and validation, robustness analysis for computer simulations, a history of successful implementations, and the role of expert knowledge in simulations. In the last decades there has been a great controversy about the scientific status of emotion categories. This controversy stems from the idea that emotions are heterogeneous phenomena, which precludes classifying them under a common kind. In this article, I analyze this claim—which I call the Variability Thesis—and argue that as it stands, it is problematically underdefined. To show this, I examine a recent formulation of the thesis as offered by Scarantino (2015). On one hand, I raise some issues regarding (...) the logical structure of the claim. On the other hand, and most importantly, I show that the Variability Thesis requires a consensus about what counts as a relevant pattern of response in different domains, a consensus that is lacking in the current literature. This makes it difficult to assess what counts as evidence for or against this thesis. As a result, arguments based on the Variability Thesis are unwarranted. This raises serious concerns about some current empirical theories of emotions, but also sheds light on the issue of the scientific status of emotion categories. (shrink)

Many philosophical accounts of scientific models fail to distinguish between a simulation model and other forms of models. This failure is unfortunate because there are important differences pertaining to their methodology and epistemology that favor their philosophical understanding. The core claim presented here is that simulation models are rich and complex units of analysis in their own right, that they depart from known forms of scientific models in significant ways, and that a proper understanding of the type of model simulations (...) are fundamental for their philosophical assessment. I argue that simulation models can be distinguished from other forms of models by the many algorithmic structures, representation relations, and new semantic connections involved in their architecture. In this article, I reconstruct a general architecture for a simulation model, one that faithfully captures the complexities involved in most scientific research with computer simulations. Furthermore, I submit that a new methodology capable of conforming such architecture into a fully functional, computationally tractable computer simulation must be in place. I discuss this methodology—what I call recasting—and argue for its philosophical novelty. If these efforts are heading towards the right interpretation of simulation models, then one can show that computer simulations shed new light on the philosophy of science. To illustrate the potential of my interpretation of simulation models, I briefly discuss simulation-based explanations as a novel approach to questions about scientific explanation. (shrink)

This study aimed to develop the Three-Dimensional Filial Piety Scale and explore its psychometric properties. Based on Wang’s Three-Dimensional Filial Piety Model, our study employed a review of the current literature, in-depth interviews, and feedback from experts and the target group. An initial 36-item scale using a bipolar Likert 6-point rating scale was developed. Then item analysis and exploratory factor analysis were conducted with sample 1 (n = 617) to explore the dimensions and final items, and a 15-item scale with (...) three factors was obtained. After that, confirmatory factor analysis was conducted to validate the 3-factor structure obtained through exploratory factor analysis with sample 2 (n = 585). Next, we tested criterion-related validity with sample 3 (n = 248) and test-retest reliability with sample 4 (n = 67). The results supported the model on which this scale was based and showed three dimensions of filial piety, namely the balance of interests, good affections, and family role norms. As a valid, reliable scale, the Three-Dimensional Filial Piety Scale can therefore be used in the Chinese context to measure filial piety for people of different genders, ages, and cohabitation situations. Functionalism as a philosophical position has been recently applied to the case of emotion research. However, a number of objections have been raised against applying such a view to scientific theorizing on emotions. In this article, I argue that functionalism is still a viable strategy for emotion research. To do this, I present functionalism in philosophy of mind and offer a sketch of its application to emotions. I then discuss three recent objections raised against it and respond to each of (...) them. These objections claim that functionalism is intractable because (i) it does not support a scientifically interesting taxonomy of emotions for experimental settings, (ii) it is inherently teleological, and (iii) it cannot be falsified. I argue that these objections either rely on a simplified version of functionalism as a philosophical position or they pose challenges that functionalists can readily address. Lastly, I conclude by drawing some lessons these objections suggest for a tractable functionalist account of emotions. (shrink)

When one wants to use citizen input to inform policy, what should the standards of informedness on the part of the citizens be? While there are moral reasons to allow every citizen to participate and have a voice on every issue, regardless of education and involvement, designers of participatory assessments have to make decisions about how to structure deliberations as well as how much background information and deliberation time to provide to participants. After assessing different frameworks for the relationship between (...) science and society, we use Philip Kitcher's framework of Well-Ordered Science to propose an epistemic standard on how citizen deliberations should be structured. We explore what potential standards follow from this epistemic framework focusing on significance versus scientific and engineering expertise. We argue that citizens should be tutored on the historical context of why scientific questions became significant and deemed scientifically and socially valuable, and if citizens report that they are capable of weighing in on an issue then they should be able to do so. We explore what this standard can mean by looking at actual citizen deliberations tied to the 2014 NASA ECAST Asteroid Initiative Citizen forums. We code different vignettes of citizens debating alternative approaches for Mars exploration based upon what level of information seemed to be sufficient for them to feel comfortable in making a policy position. The analysis provides recommendations on how to design and assess future citizen assessments grounded in properly conveying the historical value context surrounding a scientific issue and trusting citizens to seek out sufficient information to deliberate. According to intellectualists, the will is a rational inclination towards apprehended goodness. This conception of the will makes its acts intelligible: they are explained by (i) the nature of the will as a rational inclination, and (ii) the judgement of the intellect that moves the will. From this it follows that it is impossible for an agent to will evil as such or for its own sake. In explaining wrongdoing intellectualists cite cognitive error or the disruptive influences of the passions; (...) these considerations, however, seem involuntary and at least partly exculpatory. The intellectualist needs an account that renders wrongful actions intelligible without undermining their status as responsible. I argue that Leibniz has the theoretical tools to provide at least part of an answer to this problem. In sum, an agent is directly responsible for her wrongdoing if the cognitive error or the disruptive influence of the passions that help explain this wrongdoing do not completely undermine her acting freely; an agent is indirectly responsible for her wrongdoing if she is directly responsible for previous actions which partly resulted in her wrongdoing, even if the presence of cognitive error or disruptive influence of the passions completely undermines her acting freely. We would like to thank the authors of the commentaries for their critical appraisal of our feature article, Who is afraid of black box algorithms?1 Their comments, suggestions and concerns are various, and we are glad that our article contributes to the academic debate about the ethical and epistemic conditions for medical Explanatory AI. We would like to bring to attention a few issues that are common worries across reviewers. Most prominently are the merits of computational reliabilism —in particular, when (...) promoted as an alternative to transparency—and CR as necessary but not sufficient for delivering trust. We finalise our response by addressing concerns about the place and role of artificial intelligence in medical decision-making and the physician’s responsibilities. We understand the concerns and reservations that some of the reviewers express regarding the epistemic merits of CR. Carlos Vaz Ferreira argues that the problem of freedom is conceptually distinct from the problem of causal determinism. The problem of freedom is ultimately a problem regarding the ontologically independent agency of a being, and the problem of determinism is a problem regarding explanations of events or acts in terms of the totality of their antecedent causal conditions. As Vaz Ferreira sees it, failing to keep these problems apart gives rise to merely apparent but unreal puzzles pertaining to the nature (...) of freedom and its relation to determinism. According to the first interpretation, computer simulations are techniques for finding the set of solutions to a mathematical model. I call this first interpretation the problem-solving technique viewpoint. In its second interpretation, computer simulations are considered to describe patterns of behavior of a target system. I call this second interpretation the description of patterns of behavior viewpoint of computer simulations. This (...) article explores these two interpretations of computer simulations from three different angles. First, I collect a series of definitions of computer simulation from the historical record. I track back definitions to the early 1960s and show how each viewpoint shares similar interpretations of computer simulations—ultimately clustering into the two viewpoints aforementioned. This reconstruction also includes the most recent literature. Second, I unpack the philosophical assumptions behind each viewpoint, with a special emphasis on their differences. This article asks the question, ``what is reliable machine learning?'' As I intend to answer it, this is a question about epistemic justification. Reliable machine learning gives justification for believing its output. Current approaches to reliability (e.g., transparency) involve showing the inner workings of an algorithm (functions, variables, etc.) and how they render outputs. We then have justification for believing the output because we know how it was computed. Thus, justification is contingent on what can be shown about the algorithm, (...) its properties, and its behavior. In this paper, I defend computational reliabilism (CR). CR is a computationally-inspired off-shoot of process reliabilism that does not require showing the inner workings of an algorithm. CR credits reliability to machine learning by identifying reliability indicators external to the algorithm (validation methods, knowledge-based integration, etc.). Thus, we have justification for believing the output of machine learning when we have identified the appropriate reliability indicators. CR is advanced as a more suitable epistemology for machine learning. The main goal of this article is to lay the groundwork for CR, how it works, and what we can expect as a justificatory framework for reliable machine learning. (shrink)

Despite the growing interest and supporting evidence for person-centered care, there is still a fundamental disagreement about what makes healthcare person-centered. In this article, we define PCC as operating with three fundamental conditions: personal, participatory and holistic. To further understand these concepts, we develop a framework based on the theory of affordances, which we apply to the healthcare case of rehabilitation and a concrete experiment on social interactions between persons with cerebral palsy and physio- and occupational therapists. Based on the (...) application of the theory, we argue that in order for healthcare to be considered as PCC, professionals need to adopt a personalistic attitude in their care, defined in terms of mutual affordances: how the professional and the person of care acknowledges each other as a person in an interaction. In opposition, we define the functionalistic attitude in terms of object affordances, those related to a concrete goal. We show that PCC requires a balance of personalistic and functionalistic attitudes, since this contributes to a participatory and holistic conception of, and interaction with, the person of care. Los autores y promotores de las transgresiones recurren sistemáticamente a la legitimidad democrática de la que gozan para justificar sus acciones. Se presentan como meros defensores y ejecutores de la voluntad popular y alegan su obligación de mantener incólume el orden estatal y de preservar las condiciones (...) que hacen posible la libertad de los ciudadanos. Este libro insiste en la inevitabilidad del conflicto entre las compulsiones inherentes al Estado en cuanto a organización de poder y sistema de dominación que compite incansablemente con otros estados y las exigencias éticas y jurídicas del orden social. Ahora bien, no se limita a deplorar esta condición ni a insistir ingenuamente en la necesidad de reafirmar la intangibilidad de los valores fundamentales y de las reglas que hacen posible la civilización humana, sino que entra de lleno en la discusión de los peligros que dimanan de la conjunción de poder y democracia. Tanto en la medida en que el poder burla el mandato democrático como en la medida en que el plebiscito democrático puede dar pábulo y justificación a los desmanes del poder. In this paper I will critically assess a very popular interpretation of Heidegger’s early thought, according to which meaning (Bedeutung) is conceived as ontologically dependent on human existence (Dasein). In order to criticize this subjectivist understanding of meaning, I will offer an interpretation of Heidegger’s analysis of signs in Being and Time (§17). This will reveal two main things: first, that the ubiquity of sign-phenomena is founded on the universality of the structure known as reference (Verweisung); second, that Heidegger’s idea (...) of reference offers a non-substantialist understanding of meaning and its relation to the world. This paper examined the relationship between coaches and youth athletes in China by comparing data collected before and after the lockdown. A total of 221 youth athletes aged 13-19 years in one professional football school completed coach-athlete relationship questionnaires. The rank-sum test was used to verify the differences in the data. The results of the Mann-Whitney U test showed that the mean value of the three dimensions of the coach-athlete relationship (closeness, commitment, and complementarity) increased after the COVID-19 lockdown. The (...) results also showed that athletes of different age categories showed different changes in the coach-athlete relationship after the lockdown, and the changes were not significantly related to the severity of the COVID-19 epidemic. En sus textos los lectores españoles han encontrado elementos que sintonizan constructivamente con los cambios acaecidos en su propia sociedad y en el mundo. Jorge Portilla argues that authentic philosophical inquiry plays a liberating function. This function is that of bringing more fully to consciousness aspects of identities or ways of being‐in‐the world that have been, up until then, tacit or opaque to the agent herself to facilitate her endorsement, rejection, or modification of these identities. For Portilla, this function facilitates greater self‐mastery by increasing the range of free variations of subjectivity available to the agent, and this increase in self‐mastery itself constitutes a kind (...) of liberation. The main goal of this article is to provide a substantive interpretation of the nature of liberation Portilla thinks is embedded in this central function of authentic philosophical inquiry. I argue that this type of liberation should be understood ultimately in terms of increases in human agency, so I label it “agential liberation.” For Portilla, agential liberation involves two central elements: (i) a type of agential flourishing central to human flourishing, and (ii) an increase in the reach of intentional action that I describe as an expansion in the arena of human agency. Para ello, primero enmarcaré la discusión dentro de la interpretación heideggeriana del naturalismo y su manera de entender la relación entre filosofía y ciencia. Luego, analizaré su interpretación de la embriología y la ecología mediante la cual Heidegger esboza aportes originales a la filosofía de la biología, especialmente en torno al problema de la identidad del organismo biológico. Finalmente, mostraré cómo esta (...) interpretación supone una profunda crítica a las concepciones sustancialistas del organismo a favor de una concepción relacional y procesual. (shrink)

El siguiente trabajo analiza las acciones artísticas ligadas al Colectivo Escena Política que tuvieron lugar en la ciudad de Buenos Aires entre 2013 y 2016. Daremos cuenta de tres formas específicas de intervención artístico-política en el espacio público. La primera relacionada con una denuncia de la explotación laboral de los artistas escénicos en la ciudad. La segunda vinculada a prácticas micropolíticas que denominamos activismo de lo sensible. Y la tercera, relacionada con la lucha llevada adelante por la Asamblea Lopérfido Renunciá (...) Ya, en conjunto con organismos de derechos humanos. En última instancia, el artículo propone que la eficacia política del activismo artístico depende de su articulación sincrónica con las diversas luchas que atraviesan el entramado social. (shrink)

Munch-Jurisic’s account of perpetrator disgust raises important new questions concerning the complexity of emotions and their connection with moral actions. In this commentary, we discuss this account by applying some of the author’s ideas to the case of anger. We suggest that just as the relations between disgust and moral action are much more nuanced than previously thought, as Munch-Jurisic explains, analyses of anger can also profit from a more careful approach to such connections. Specifically, we propose that contextual factors (...) can affect the moral character of anger reactions, which in turn can provide them with moral value. We also argue that the contextual view deployed to study disgust reactions can also support distinctions between core forms and socio-moral forms of the same emotion, which in turn raises interesting questions concerning different forms of anger. Lastly, we extend the contextual approach to problems of emotion individuation and theories in emotion science, showing how current scientific emotion theories can learn from a detailed examination of disgust, anger, and other context-sensitive emotions. We aim to highlight some important contributions of Munch-Jurisic’s work to broader discussions on emotions, morality, and how to theorize about emotions overall. (shrink)

There is considerable evidence that the experience of justice is associated with perceived legitimacy of authority, but there has been no research about this association when considering past rather than current fairness. Based on the fairness heuristic theory, we tested the hypothesis that interpersonal justice trajectories positively affect perceived legitimacy of the authority; we also tested whether social class moderated this effect. Community residents rated the authority's fairness on 16 consecutive weeks and rated perceived legitimacy on the 16th week. The (...) results of latent growth modeling showed that the trajectory of interpersonal justice scores leading up to the final week significantly predicted perceived legitimacy, regardless of the current experience of interpersonal fairness. Tests of moderation showed that the legitimacy perceptions of individuals of lower subjective social class were significantly affected by interpersonal justice trajectories, whereas this was not the case among individuals of higher subjective social class. The results are discussed in terms of their implications for research on perceived legitimacy and justice, as well as their implications for understanding social class. (shrink)

In Olivi´s division of the sciences, which can be found in his treatise De perlegendis philosophorum libris, c. 9, there seems to be a twofold place for metaphysics: one as part of the theoretical sciences and another as part of the practical, alongside medicine and ethics. This view is based on a misreading of the manuscripts. For the second appearance of metaphysics one should read “mechanica” instead. Thus, this paper shows that the thesis of an unconventional approach to metaphysics in (...) Olivi cannot be sustained by De perlegendis philosophorum libris. (shrink)

In this article, I focus on the role of computer simulations as exploratory strategies. I begin by establishing the non-theory-driven nature of simulations. This refers to their ability to characterize phenomena without relying on a predefined conceptual framework that is provided by an implemented mathematical model. Drawing on Steinle’s notion of exploratory experimentation and Gelfert’s work on exploratory models, I present three exploratory strategies for computer simulations: (1) starting points and continuation of scientific inquiry, (2) varying the parameters, and (3) (...) scientific prototyping.
